Abstract:
This research study conducts a comprehensive comparative analysis of the enforcement of fundamental human rights in two distinct regions: Africa and the First World. It seeks to explore the variances and commonalities in the mechanisms, challenges, and outcomes of protecting and upholding fundamental human rights in these contrasting contexts.
The enforcement of fundamental human rights is a cornerstone of a just and equitable society, serving as a barometer of a nation’s commitment to its citizens’ dignity and well-being. This research aims to shed light on how these rights are safeguarded and upheld in Africa, a continent with diverse political, economic, and social conditions, and in the First World, comprising developed nations with established democratic institutions and high standards of living.
To achieve this, the study employs a mixed-methods approach, incorporating both quantitative and qualitative analyses. Quantitative data will be collected through surveys and secondary sources to assess the legal frameworks and institutional mechanisms in place for protecting human rights in selected African countries and First World nations. Qualitative data will be gathered through in-depth interviews with legal experts, human rights activists, and policymakers to gain insights into the challenges and successes of enforcing these rights.
The preliminary findings suggest that while both Africa and the First World share common international commitments to human rights, there are significant disparities in their enforcement due to varying political contexts, economic disparities, and cultural factors. Africa faces unique challenges, including weak governance structures, limited resources, and historical legacies, which impact the realization of human rights. Conversely, First World nations, although generally better equipped to enforce these rights, encounter issues related to privacy, surveillance, and the treatment of vulnerable populations.
