ELECTRONIC WASTE IN NIGERIA; STEMMING THE TIDE ENFORCEMENT OF FOREIGN JUDGMENTS IN NIGERIA
Abstract:
The electronic waste (e-waste) crisis has emerged as a pressing global issue with severe environmental and health ramifications. Nigeria, as one of Africa’s largest and most populous nations, faces a growing challenge in managing its e-waste problem. This paper explores the complex issue of electronic waste in Nigeria and advocates for an effective solution through the enforcement of foreign judgments.
Nigeria’s rapid technological advancement and increased consumption of electronic devices have led to a surge in e-waste generation. Unfortunately, the country lacks the infrastructure and regulatory framework to manage and dispose of e-waste safely. Consequently, informal recycling practices, often involving hazardous materials and methods, have become commonplace, posing grave threats to both the environment and public health.
To address this issue, the paper examines the role of international conventions and treaties related to e-waste management, emphasizing the importance of enforcing foreign judgments against foreign corporations and entities responsible for exporting e-waste to Nigeria. The international legal framework provides avenues for holding foreign actors accountable for their role in exacerbating Nigeria’s e-waste problem.
Furthermore, the study explores the challenges and opportunities in implementing and enforcing foreign judgments within Nigeria’s legal system. It discusses the need for legislative reforms, capacity building, and inter-agency collaboration to facilitate the effective enforcement of judgments against foreign e-waste exporters.
The paper concludes by emphasizing the urgency of addressing Nigeria’s e-waste crisis and the significance of enforcing foreign judgments as a viable means of holding transnational entities accountable. By combining international legal mechanisms with domestic regulatory reforms and increased public awareness, Nigeria can take substantial steps towards stemming the tide of electronic waste, safeguarding its environment, and protecting the health and well-being of its citizens.
