HUMAN RIGHTS, ENVIRONMENT AND CONFLICTS: LEGAL APPROACH IN ADDRESSING CRIMES AGAINST THE ENVIRONMENT IN NIGERIA

Abstract:

This paper investigates the intricate nexus between human rights, environmental protection, and conflicts in the context of Nigeria, a nation facing escalating environmental challenges and related disputes. Focusing on legal strategies to combat crimes against the environment, this study explores the evolving landscape of environmental law, its intersections with human rights law, and its efficacy in addressing environmental degradation and associated conflicts in Nigeria.

The analysis commences by delineating the environmental degradation and conflicts plaguing Nigeria, ranging from oil spills in the Niger Delta to deforestation in the country’s forested regions. It underscores the profound impact of these environmental crises on the livelihoods, health, and overall well-being of vulnerable communities, raising critical human rights concerns.

Subsequently, this research delves into the existing legal frameworks within Nigeria and their alignment with international human rights and environmental standards. It critically evaluates the Nigerian legal system’s capacity to address environmental crimes, ensuring accountability for those responsible and safeguarding the rights of affected communities.

Furthermore, the paper examines key international legal instruments, treaties, and conventions that Nigeria is a party to, highlighting the obligations and opportunities they present for addressing environmental crimes. The study also explores precedents from other jurisdictions to offer comparative insights and best practices in tackling crimes against the environment through legal means.

Drawing from specific cases and instances of environmental degradation and conflict in Nigeria, this research illustrates the complexities of enforcing environmental and human rights protections within the country’s legal framework. It underscores the challenges related to legal enforcement, access to justice, and the capacity of governmental institutions to respond effectively.

Ultimately, this study underscores the need for a holistic legal approach that harmonizes environmental protection, human rights, and conflict resolution in Nigeria. It advocates for strengthening domestic legislation, enhancing institutional capacity, and promoting the active involvement of affected communities in shaping environmental policies and seeking justice. By doing so, this paper aims to contribute to the ongoing discourse on safeguarding both the environment and human rights in Nigeria while fostering a deeper understanding of the legal avenues available for addressing crimes against the environment in this context.
